Pixel Framers LLC 2220 Landmark Place STE 8 Manasquan, NJ 08736 USA
These Terms govern your access to and use of Crosstab, including our browser extensions, websites, APIs, documentation, and related services (collectively, the “Services”). By installing, accessing, or using the Services, you agree to these Terms.
Headline Obligations (Read This):
Third-Party Terms: If you use Crosstab on a third-party site or app (e.g., social networks, SaaS tools), you must comply with that provider’s terms, policies, and rate limits. If their rules forbid automation or data export, you must not use Crosstab in a way that violates those rules.
Rate Limits & Fair Use: Do not exceed plan limits or engage in abusive high-volume activity. We may throttle, suspend, or terminate accounts that exceed limits or create undue load or risk.
Your Responsibility: You control what you capture or export with Crosstab. You are solely responsible for ensuring you have the legal right to collect, transform, store, and use that data.
1) Acceptance of Terms
By clicking “I agree,” installing a Crosstab extension, creating an account, or otherwise using the Services, you accept these Terms. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization and that the organization accepts these Terms.
2) Definitions
“Crosstab” means the Services operated by Pixel Framers LLC.
“User Content” means data, text, images, metadata, and other material you capture, transform, upload, export, or otherwise process via the Services.
“Third-Party Platform” means any website, application, or service not owned or controlled by Pixel Framers (e.g., professional networks, CRM tools, SaaS applications).
“Plan” means any free, trial, or paid subscription tier with usage parameters and features published by Crosstab at purchase or enrollment.
3) Eligibility
You must be at least the age of majority in your jurisdiction (and in any case 16+) to use the Services. You may not use the Services if you are barred from doing so under applicable law or under sanctions/embargoes.
4) Account Registration & Security
Provide accurate, complete registration information and keep it updated.
Maintain the security of your credentials and extension environment. You are responsible for activity occurring under your account.
Notify us promptly of suspected unauthorized use or security incidents.
5) License to Use the Services
Subject to these Terms, Crosstab grants you a limited, revocable, non-exclusive, non-transferable license to install and use the browser extension and related Services solely for lawful, internal purposes and in accordance with your Plan.
6) Permitted Use; Fair Use
Crosstab is designed to help you transform and export content that is already rendered in your browser session into clean, structured data. “Fair Use” here means usage that is consistent with your Plan, does not degrade or risk the Services, and respects Third-Party Platforms’ rules and the rights of others.
You may use the Services to capture, transform, and export page content that you have lawful permission to access in your own session.
You must respect robots.txt, API terms, automation policies, and any functional limits imposed by Third-Party Platforms.
You may not use Crosstab to obtain or use content in a way that infringes intellectual property, violates privacy laws, or breaches contracts or terms with third parties.
7) Prohibited Activities
Using the Services to violate any law, court order, regulatory requirement, or third-party contract/terms.
Circumventing technical measures, captchas, access controls, or rate limits.
Automating interactions where a Third-Party Platform forbids automation or data export.
Exceeding your Plan’s usage parameters or attempting to bypass metering, throttling, or quotas.
Reverse engineering, decompiling, or attempting to extract source code except to the extent permitted by law.
Introducing malware, scraping at abusive volume, or creating undue load on Third-Party Platforms or the Services.
Collecting sensitive or special-category personal data without a lawful basis and required consents.
Required Compliance: You must comply with each Third-Party Platform’s terms, policies, developer rules, and rate limits when using Crosstab on that platform. If a platform’s terms prohibit automation, scraping, bulk export, or reuse of data, you must not use Crosstab to perform those actions.
Your relationship is with the Third-Party Platform. Crosstab is not affiliated with, endorsed by, or responsible for Third-Party Platforms’ policies or enforcement.
Permissions & Access: You are responsible for obtaining and maintaining any necessary permissions, licenses, or consents from the Third-Party Platform and any data subjects.
Platform Requests: If we receive a complaint or lawful request from a Third-Party Platform, we may limit functionality, throttle, suspend, or terminate access to preserve compliance.
Credentials: Do not share or store platform credentials in insecure ways. If you authorize Crosstab to interact with a platform on your behalf, you remain responsible for that access and for revoking it when appropriate.
9) Rate Limits, Throttling & Anti-Abuse
Your Plan may include specific usage parameters (e.g., number of exports, requests per time period, maximum record counts, or concurrency). We may also enforce dynamic protections to safeguard platforms and our infrastructure.
Plan Limits: You must stay within the published limits for your Plan. We may meter usage at the account and/or extension level.
Throttling: We may automatically throttle or delay operations that appear abusive or exceed limits (e.g., bursts, parallelization, or scripting that mimics bot behavior).
Blocking & Suspension: Repeated or egregious violations may result in automatic blocking or account suspension/termination.
No Circumvention: You may not use multiple accounts, rotating identities, or other tactics to avoid limits or enforcement.
10) Your Content & Data
Ownership: You retain your rights to User Content. You grant Crosstab a worldwide, non-exclusive license to host, process, transform, and transmit User Content solely to provide and improve the Services.
Responsibility: You are solely responsible for User Content, including obtaining required consents and ensuring that collection, transformation, storage, and sharing are lawful.
Storage & Retention: We may cache intermediate results and logs for performance, integrity, troubleshooting, and security. We are not a records-retention service; you should maintain your own backups.
Deletion: Subject to legal holds and our legitimate interests in fraud prevention and security, you may request deletion of certain data via the product or by contacting support.
11) Privacy & Data Protection
Your use of the Services is subject to our Privacy Policy (linked in the product or on our website). Where required, we may offer a data processing addendum. You must comply with applicable privacy laws, including obligations for notice, consent, disclosure, data subject rights, cross-border transfers, and security measures.
12) Intellectual Property; Feedback
Our IP: The Services, including software, documentation, designs, and trademarks (excluding User Content and third-party materials), are owned by Pixel Framers LLC and its licensors and are protected by law.
Trademarks: Names and logos of Third-Party Platforms are trademarks of their respective owners. Use in the Services is for identification only.
Feedback: If you submit ideas or suggestions, you grant Pixel Framers a perpetual, irrevocable, worldwide, royalty-free license to use them without restriction.
13) Plans, Subscriptions, Trials & Billing
Billing: Paid Plans are billed in advance on a recurring basis unless stated otherwise. You authorize us (and our payment processors) to charge your payment method for all fees, taxes, and any overages according to your Plan.
Teams & Seats: If your Plan supports multiple seats, the account owner is responsible for managing seats and ensuring user compliance. Adding seats authorizes proportional charges for the remainder of the billing period and ongoing renewals.
Trials/Promos: Trials or promotional periods convert to paid Plans unless you cancel before the end of the trial.
Changes: Upgrading/downgrading Plans modifies your features/limits and associated fees on a pro-rated basis as applicable.
Refunds: Except where required by law, fees are non-refundable. Upon cancellation, service continues until the end of the current term.
Taxes: Fees are exclusive of taxes; you are responsible for applicable taxes, duties, and government charges.
Chargebacks: Illegitimate chargebacks may result in immediate suspension or termination.
14) Changes to the Services
We may add, remove, or modify features, impose or adjust limits, or discontinue parts of the Services. If we materially change these Terms, we will provide notice via the Services or email. Continued use after the effective date constitutes acceptance.
15) Suspension & Termination
We may suspend or terminate your access immediately for violations of these Terms, suspected fraud, legal risk, or requests from Third-Party Platforms or authorities.
You may cancel at any time via your account settings; cancellation is effective at the end of the current billing term unless stated otherwise.
Upon termination, your right to use the Services ends, but certain sections survive (including, without limitation, Sections 8–9 and 12–24).
16) Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” PIXEL FRAMERS LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT THEY WILL MEET YOUR REQUIREMENTS OR BE COMPATIBLE WITH EVERY THIRD-PARTY PLATFORM.
17) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL PIXEL FRAMERS LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO US FOR THE SERVICES IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100) FOR FREE PLANS.
18) Indemnification
You will defend, indemnify, and hold harmless Pixel Framers LLC and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Services; (b) your User Content; (c) your violation of these Terms or applicable law; or (d) your interactions with Third-Party Platforms, including any alleged breach of their terms, policies, or rate limits.
19) Compliance: Export, Sanctions & Government Use
Export & Sanctions: You represent that you are not located in, and will not use the Services from, any embargoed or sanctioned jurisdiction and that you are not a prohibited party under applicable trade laws.
Government Use: The Services are “commercial items.” If acquired by or on behalf of a U.S. Government entity, use is subject to these Terms and applicable FAR/DFARS provisions.
20) Copyright/DMCA
If you believe that content available via the Services infringes your copyright, send a written notice to the address in Section 25 or to our designated email with: (i) your contact details, (ii) identification of the work and material claimed to be infringing, (iii) a statement of good-faith belief, (iv) a statement under penalty of perjury that the information is accurate and that you are authorized to act, and (v) your signature. We may remove or disable access to alleged infringing material consistent with applicable law.
21) Security & High-Risk Use
Implement reasonable security controls on your devices and accounts. Do not run modified or untrusted builds of the extension.
The Services are not designed for high-risk environments (e.g., medical devices, critical infrastructure). Do not use them where failure could lead to death, personal injury, or severe environmental damage.
22) Open Source Components
The Services may include open-source software governed by separate licenses. To the extent of a direct conflict, those licenses control for the relevant components.
23) Governing Law, Dispute Resolution & Class Waiver
Governing Law & Venue: These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules. Exclusive jurisdiction and venue lie in the state or federal courts located in New Jersey, and you consent to personal jurisdiction there.
Arbitration Option: At our election, any dispute arising out of or relating to these Terms may be resolved by binding arbitration administered by a recognized arbitral forum. If elected, the arbitration will be conducted on an individual basis, and not as a class or representative action.
Class Action Waiver: YOU AND PIXEL FRAMERS LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
24) Miscellaneous
Entire Agreement: These Terms (plus any order form or Plan terms referenced at purchase and any applicable data processing addendum) are the entire agreement between you and us regarding the Services.
Severability: If any provision is unenforceable, the remainder remains in effect.
Assignment: You may not assign these Terms without our prior written consent. We may assign to an affiliate or in connection with a merger, acquisition, or sale of assets.
No Waiver: Failure to enforce any provision is not a waiver.
Notices: We may provide notices via the Services, email, or your account dashboard. You agree to keep your contact information current.
Electronic Communications: You consent to receive communications electronically and agree that electronic agreements satisfy legal requirements.
